Acceptance of Terms
By engaging Theveloper for any project — whether via a signed quote, a deposit payment, or written confirmation to proceed — you accept these Terms & Conditions in full. If you do not agree with any part of these terms, please do not proceed with a project until we've discussed and resolved your concerns directly.
Services Provided
Theveloper provides web design, web development, e-commerce development, AI automation, technical SEO, and lead-generation services, as described on this website or in an individual project quote. The specific scope of any project is defined by the package selected or the custom quote agreed upon in writing before work begins.
Payment Terms
Unless otherwise agreed in writing:
- Projects require a 50% deposit before work begins, with the remaining 50% due upon project completion and before final handover.
- Larger custom builds may follow a milestone-based payment schedule agreed to at the start of the project.
- Pricing for standard packages is listed on our Pricing page; custom projects are quoted individually.
- Hosting, domain registration, and any third-party subscription costs (e.g., premium plugins, payment gateway fees) are billed separately unless explicitly included in your quote.
Work will not begin, and the final deliverable will not be handed over, until the relevant payment stage has been received.
Revisions & Scope Changes
Each package includes design and development within the scope originally agreed upon. Adding new pages, sections, features, or scaling the site beyond what was originally scoped is treated as additional work and will be quoted and charged separately. We'll always let you know before any extra cost is incurred — nothing outside the agreed scope is billed without your approval first.
Free Support Terms
Each package includes a period of free support, as specified on our Pricing page at the time of purchase. Free support covers:
- Bug fixes for functionality that was working at handover and has since broken
- Small technical adjustments to what was originally built
Free support does not cover new features, new pages, content updates, or third-party platform changes outside our control (e.g., a hosting provider or plugin update that affects your site). These are quoted separately or can be covered under an ongoing maintenance plan. Support periods begin from the date of final handover.
Intellectual Property & Ownership
Upon receipt of full payment, ownership of the final website design and content created specifically for your project transfers to you. This includes the live site as delivered. Unless your package explicitly includes source code and documentation (as with our Custom-Coded E-Commerce package), underlying code, reusable components, and internal frameworks developed by Theveloper remain our intellectual property and may be reused across other client projects. Until full payment is received, all work remains the property of Theveloper.
Third-Party Platforms
Where a project is built on a third-party platform (WordPress, Shopify, or similar), you are responsible for your own account, subscription fees, and ongoing platform-level compliance with that provider's terms. Theveloper is not responsible for changes, outages, or policy changes made by third-party platforms or payment gateways that are outside our control.
Client Responsibilities
To keep your project on schedule, you agree to:
- Provide content, text, images, and brand assets in a timely manner
- Respond to review requests and feedback within a reasonable timeframe
- Ensure any content you provide does not infringe on the rights of others (copyright, trademark, or otherwise)
Delays in providing the above may extend the project timeline accordingly.
Cancellation & Refunds
Should you need to cancel a project after work has begun, the initial deposit is non-refundable, as it covers time and resources already committed. If cancellation occurs after additional milestones have been paid, you will be refunded for any milestone not yet started, minus a reasonable administrative fee. No refunds are issued once a project has been completed and handed over.
Limitation of Liability
Theveloper will make reasonable efforts to deliver functional, well-tested websites and systems. However, we are not liable for indirect, incidental, or consequential damages arising from the use of a delivered website or system, including but not limited to lost revenue, lost data, or business interruption, except where such liability cannot be excluded under applicable law. Our total liability for any project is limited to the amount paid by the client for that specific project.
Confidentiality
Any business or project information you share with us during the course of a project will be treated as confidential and used only for the purpose of delivering your project, unless you give us permission to showcase the work publicly (for example, in our portfolio or testimonials).
Governing Law
These Terms & Conditions are governed by the laws of India. Any disputes arising from a project engagement will be subject to the exclusive jurisdiction of the courts of Puducherry, India.
Changes to These Terms
We may update these Terms & Conditions from time to time. Changes will not apply retroactively to projects already agreed upon in writing, but will apply to any new engagement made after the update. The "Last updated" date at the top of this page reflects the most recent revision.
